OhYouPrettyThing‘s online shopping terms and conditions apply to all orders which You, the Customer, place when using this Website "www.ohyouprettything.com" which is operated by Us. Before placing Your order, We suggest that You read through them for Your benefit.
To accept and agree to be bound by Our On-line Shopping Terms and Conditions and Privacy Policy, please click on the "Accept" button. These Terms and Conditions, together with Our Privacy Policy and any other policies and amendments that We notify You of in the future, constitute the entire agreement between You and Us. Our On-line Shopping Terms and Conditions preserve Your statutory rights as a Customer.
ORDERS
We accept orders only from either an adult (over 18 years old) or a child whist under the supervision of an adult for the duration of the ordering and payment process on Our Website.
OVERSEAS ORDERS
OhYouPrettyThing is based in the United Kingdom (i.e. mainland Britain and Northern Ireland, excluding the Channel Islands and Isle of Man). If You choose to access this Website from outside the United Kingdom then You are deemed responsible for compliance with Your local laws regarding import duties levied on Your goods imported from Our premises based in the United Kingdom.
If You order items from Our Website and are resident overseas then You are deemed the importer of the goods. For deliveries outside the United Kingdom, import duties and taxes may be levied on the goods’ arrival in Your country by Your local customs authority which will be Your own responsibility. Please note that imported goods maybe subject to inspection by Your local customs authority. If in doubt, it is advised that You contact Your local customs office for relevant information prior to ordering goods from Our Website.

Please note that any/all measurements are approximate.
Great care is also taken in ensuring that the colours of Our items are shown in the photographs to be as near as possible to the item’s true colours. What is shown on Your own computer is subject to Your own monitor’s resolutions.
STOCK AVAILABILITY
In the event of a mishap occuring to Your ordered item whilst in Our care prior to dispatch, We will contact You using the contact details You supplied to Us to inform You of this before cancelling Your order and refunding You fully for Your payment for the item.
If We are unable to contact You or do not receive a response from You, We will process any remaining items on Your order and refund You for the items We were unable to supply.
CUSTOMER PROFILE
To help and ensure that Your Customer registration, verification, payment, postal and contact details are correct and complete at all times, please inform Us immediately of any changes to Your personal details. Access to Your registration details are through “Your Profile”.
Please note that You will be responsible for all activities that occur under Your account username and password and for taking all necessary steps to maintain the confidentiality of Your account username and password and for preventing unauthorised access to Your profile.
If You believe that Your username and/or password has become known to anyone else, or are being, or are likely to be, used in an unauthorised manner, please inform Us immediately so that We may allow You to choose an alternative password. We will contact You as soon as is reasonably possible. You agree to accept that We may contact You for customer verification of future orders for as long as deemed necessary for Your security and Ours.
We reserve the right to refuse access to Our Website, to terminate accounts, to change prices (not on sold items), to remove or edit content, or cancel orders at Our discretion. When We cancel orders, We shall notify the Customer and refund the Customer fully for these orders.

COMMUNICATION
Under OYPTs On-line Shopping Terms and Conditions, We fulfill Our obligations toYou when We communicate with You by e-mail and by posting notices on Our Website. You agree to receive Our electronic communications and accept that Our electronic communications in writing (by email) will satisfy any legal requirements.
CUSTOMER/SELLER CONTRACT
A sales contract is formed between You, the Customer and Us, OhYouPrettyThing by the following processes:
Firstly when the Customer offers to buy Our goods by ordering the goods and agreeing to buy by paying Us for the goods.
Secondly, OhYouPrettyThing confirm They have accepted Your offer to buy by sending You an “Order Confirmation Email”.
Thirdly and finally, the sales contract becomes legally binding between You and Us when OhYouPrettyThing accepts Your order to buy the goods by sending You a “Confirmation of Dispatch” email which lists the goods ordered by You as listed in the “Order Confirmation Email”
In the case of a multiple items order, if any of the goods ordered by You are not itemised in the “Confirmation of Dispatch” email, then those missing items do not form part of that contract. The items which are omitted shall be in a new contract in a new and separate “Confirmation of Dispatch” email if the goods are still required.
PRICES
Prices are in GBP sterling as default. US dollars and Euros are also accepted by Us. US dollar and Euro prices can be selected from the currency drop-down menu. It is suggested that the currency You require is selected prior to browsing the Website to eliminate any chance of error in budgeting whilst browsing for Your purchases.
Prices which are displayed at the time of ordering and entered in the invoice is the amount You will be charged for the item(s) which includes any Value Added Tax (VAT) at the current rate that is payable.
We reserve the right to update Our prices (not sold items) whenever it is deemed appropriate by Us.
A delivery fee is also charged and is added to Your bill. Please see Our carriage chart for details.
If You request additional postage services then this will be deemed an “extra requested service” such as express delivery etc which is not stated as one of Our choices of delivery services and will not be refundable even in the case of returned items as this will be a separate contract between You and Us. Only Our stated postal service prices will be refunded together with the ordered item’s price .

In the rare event of an item You have ordered being priced incorrectly due to human error, We shall contact You in order to inform You and to ask You to either re-confirm Your order at the correct price or to cancel it. If You are unavailable to consult over this matter, We will regretfully cancel Your order.
PAYMENTS
OhYouPrettyThing accepts online payments by either secure credit/debit card or Paypal payment via our payment provider Paypal. No other form of payment is accepted.
Payments from UK and overseas Buyers only accepted in Pounds Sterling, Euros or US Dollars by debit/credit card via Protx within 7 days of ordering whereby the ordered goods shall be held at the prices stated in Your invoice within this time limit.
UK and Overseas Buyers please contact Us for P&P charge to Your destination before paying if not automatically calculated and included on Your total bill.
Credit/debit card payments should be made by entering Your information on Our secure online order form. Please see Our Privacy Policy for details on how We protect Your personal information. We cannot guarantee and therefore cannot be accountable for any breach of security of any data which is sent to Us by email so please do not send Us Your information by this means.
Authorisation of Your credit/debit card payment will then be automatically asked for by Us from Your card issuer. When a valid authorisation is received, Your card issuer will hold this value and a charge for the card payment will be due by Us to the card issuer for the transaction.
We will not be liable to You for any losses caused as a result of unauthorised access to Your personal and transactional information which is provided by You when placing Your order unless We are proved negligent or fraudulent.
Receipt of Your credit card details and debit of payment does not constitute Our acceptance of Your order.
Please note that ownership of items purchased does not pass to You until payment is received by Us in full and the item is delivered to You.
ITEMS LOST OR DAMAGED IN TRANSIT
In the event of non-delivery of Your item, please contact Us within 10 working days of notification of dispatch of the item in order for Us to investigate the whereabouts of the item. We always send orders by Recorded Delivery or a similar service from another courier in order to obtain Proof of Postage and delivery.
In the event of items damaged in transit, please contact Us within 7 working days of receipt of the item preferably with photographic evidence of the damage. We will require You to post the damaged item back to Us preferably wrapped in or including the original wrapping and then overwrapped, within 30 days of receiving the item. A full refund will be given to You including the cost of normal postage and packing, within 30 days as required by EU law.
CANCELLATION OF ORDERS
Notification of the cancellation of Your order or part order is required within 7 working days from the day after the day the item is delivered to the delivery address You gave Us as stated by European Union (EU) law. On receiving notification of the cancellation of goods received, We shall amend Our records and make suitable arrangements, if appropriate, for the return of the goods and any replacement or refund to You which will be executed within 30days as also required by EU law.
If an order has already been processed and dispatched to You, it is not possible to cancel the delivery of the order so, We will require, in this instance, for You to return the items to Us when delivered, at Our expense, in accordance with Our Returns Policy above.
If You have received a requested additional service with Your delivered order ie gift wrapping or an express or priority courier service etc then this is deemed a separate contract and therefore cannot be cancelled by You for the service has already been given, so the fee for this service will not be refunded.
A refund for the relevant cancelled goods that were ordered together with the normal stated postal service charge will be granted on notice of Your cancellation.
Returned goods are accepted within 7 days of receiving the said goods at the delivery address given by You unless the goods are earrings for pierced ears or undergarments which are not accepted for return due to reasons of hygiene. Your statutory rights are not infringed by this stipulation.
Please ensure the safety of the goods whilst in Your care prior to returning.
It is the Customer’s responsibility to take reasonable steps to ensure the safe return of the goods, preferably wrapped within or including their original packaging then overwrapped.
Please be aware that the condition and inclusion of the original packaging of a vintage or antique item adds considerably to the value of the item, so with this in mind, please also take care of the item’s original packaging.
REFUNDS
After a refund is considered and deemed appropriate, any monies due shall be refunded within 30 days from the date that the refund was requested.
FINALLY
We shall not be responsible to You for any personal, business or third party losses not forseeable by Us or Yourself ie beyond Your and Our reasonable control, other than those covered within the above terms and conditions whilst strictly adhering to EU regulations.
When browsing, using Our Website or ordering items from Our Website, You are required to read and adhere to Our terms and conditions which are in compliance to EU regulations concerning Distance Selling.
Changes in the law which concerns online selling may affect orders which You have already sent Us. In this case, We would contact You to inform You of the changes and would require both You and Us to cancel the order forthwith and ask You to re-order whilst adhering to the new laws.
Any breach of these On-line Shopping Terms and Conditions by You will deem Us entitled to enforce Our rights legally in order to maintain a safe and legal ecommerce sales website.
